Marital Rape and Middle-Class Dilemma: Between Social Status and Legal Silence

Abstract

Marriage is stated as a sacred bond in India. It has been recognised that in the eyes of law, any violent activity which takes place against women due to a matrimonial dispute is criminalised to protect the rights and interests of women. As crime against women had traced back through history but the abrupt practices which take place within the four walls of a house always remained ignored, which is marital rape. In this research paper, attempts have been made to throw light on the challenges faced by middle-class women who always remain silent instead of taking action because of societal norms, family burden and why legal silence is there and what reforms can be taken place in order to change the current situation.
