GDPR Compliance In AI-Based “Right To Work” Checks For UK Employers

Abstract
Employers are conducting automated Right to Work checks with the aid of artificial intelligence technologies required under the United Kingdom immigration compliance legislation. These systems scan biometric marks, identity papers and electronic confirmation records in order to determine whether a person is legally entitled to work in the country or not. The rise in automated verification software usage is an indicator of the larger trends of computerised governance and exploitation of technology to enable regulatory compliance. The research shall be conducted using the doctrinal approach to law and the applied legal analysis to investigate the law that regulates the use of AI-based employment verification systems. The paper evaluates such legislative frameworks as UK General Data Protection Regulation and the Data Protection Act of 2018 and regulatory frameworks like Digital Identity and Attributes Trust Framework that govern the provision of digital identity verification in the United Kingdom.This paper suggests that AI-enhanced Right to Work verification tools cannot be reconciled with GDPR features that address automated decision-making, transparency, and fair play when the employers solely use automated outcomes and conflict with the involvement of human factors. There are also dangers of algorithm bias, wrong identity verification and lack of transparency in decision making which can be caused by automated identity verification technologies. The report concludes that AI-based employment verification requires additional heavy regulation protection. Human supervision and stricter regulation of the employers should be added to ensure that the principles of the GDPR of fairness, accountability, and data protection are followed.
